Walker v. RTTL Update

Plaintiff files response in opposition to motion to dismiss

Counsel for Michelle Walker filed a response in opposition to RTTL's motion to dismiss her lawsuit. The response included many pages of social media posts, none of which pass the 3-part commercial speech test, and most of which occurred well before Walker's application to RTTL. The response's exhibits also featured various documents and web archives from years ago, well before the period of time referenced in the original Complaint.

Plaintiff's counsel addressed the lack of any contact whatsoever between Walker and anyone who owned land, and the lack of any bona fide offer to sell real estate to her, by attempting to strip these requirements via some interesting and questionable case law citations. Defendants' counsel will address these creative legal theories.

The response was filed at 11:51 PM on Saturday night, 9 minutes before their filing deadline.
